1. General

These terms of sale and delivery apply to all business relationships between us and the buyer. Deviating agreements, in whatever form, are only binding if confirmed by us in writing.

2. Offer

The items we specify are subject to change in price, quantity and delivery time, prices in Euro excl. VAT. The stated retail prices are non-binding recommended retail prices.

3. Retention of Title

Our goods remain our property until full payment of the purchase price and ancillary claims. When bills of exchange or cheques are accepted, payment is only deemed made upon their final redemption. Ancillary claims include in particular costs for packaging, freight, insurance, bank charges, reminder fees, legal, court and other costs. In the case of a running account, the retention of title serves as security for our balance claim. Already paid goods remain our property as long as we still have any claims against the buyer.

4. Delivery

Shipping is at the expense and risk of the recipient from our Vienna warehouse, while stocks last.

5. Cancellation

Should orders placed in advance or delivery dates be cancelled, we reserve the right to charge a cancellation fee of 20% of the order value. Cancellation of logo merchandise orders is not possible.

6. Payment Terms

Our listed prices are in Euro plus postage and the applicable value added tax. We grant a 2% cash discount for payment within 10 days of the invoice date, net cash within 30 days of the invoice date. Items marked N/N (=net/net) are net prices with no cash discount available and are due immediately.

7. Complaints and Returns

Complaints must be made within 6 days of receipt of the goods. Transport damage must be immediately confirmed by the carrier (post, parcel service or freight forwarder). Replacement deliveries are only guaranteed free of charge if clearly established manufacturing defects are involved. Returns are only accepted after prior telephone arrangement and with a complaint number provided by us. Returns must in all cases be shipped FREE.

8. Damages

Claims for damages of any kind against us are excluded unless gross negligence is proven. In any case, our liability is limited to the amount invoiced for the goods. No liability is assumed for consequential damages or pure financial losses.

9. Warranty

We assume no warranty that the marketing of the goods we deliver does not infringe trademarks, design rights, copyrights or other rights of third parties.

10. Jurisdiction

Place of jurisdiction: Vienna.
